Terms of Service

Please read these terms carefully before using the app or this website.

These Terms of Service ("Terms") govern your access to and use of the Informed Fishing mobile application, website, and related services (collectively, the "Services") operated by Blue Sky Invention Company, LLC d/b/a Informed Fishing ("Informed Fishing," "we," "our," or "us").

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Services.

1. Eligibility

You must be at least thirteen (13) years old to use the Services.

By using the Services, you represent and warrant that:

  • You are at least 13 years old;
  • You have the legal capacity to enter into these Terms; and
  • Your use of the Services complies with all applicable laws and regulations.

2. Description of Services

The Services provide fishing-related information, forecasts, fishing activity scores, weather and environmental data, fishing logs, educational content, artificial intelligence-assisted features, premium subscription features, e-commerce functionality, and related services.

The Services are intended for informational and entertainment purposes only.

3. Account Registration

Certain features require the creation of an account.

You agree to:

  • Provide accurate and complete information;
  • Maintain the security of your account credentials;
  • Promptly update account information when necessary; and
  • Notify us immediately of any unauthorized use of your account.

You are responsible for all activity occurring under your account.

4. Subscription Services

Certain features are available only through paid subscriptions.

Subscriptions may be offered on a monthly or annual basis.

Automatic Renewal

All subscriptions automatically renew at the end of the applicable billing period unless canceled before renewal.

By purchasing a subscription, you authorize us and our payment processors to charge your payment method on a recurring basis until canceled.

Cancellation

You may cancel your subscription at any time through your Apple App Store account, Google Play account, or other applicable billing platform.

Cancellation prevents future renewals but does not entitle you to refunds for the current subscription period unless required by law.

Pricing Changes

We reserve the right to modify subscription pricing at any time. Any pricing changes will apply to future billing periods.

5. Purchases of Products

The Services may allow users to purchase products directly from us or through third-party merchants.

All purchases are subject to applicable pricing, taxes, shipping fees, return policies, and other terms presented at the time of purchase.

We are not responsible for products, services, or transactions offered by third-party merchants.

6. AI Features

The Services may include artificial intelligence-powered features and recommendations.

AI-generated responses may be provided through technology supplied by Google or other service providers.

You acknowledge and agree that:

  • AI-generated content may be inaccurate, incomplete, or outdated;
  • AI responses are provided for informational purposes only;
  • AI outputs should not be relied upon as professional, scientific, legal, safety, navigation, or weather advice; and
  • You are solely responsible for decisions made based on AI-generated information.

7. Fishing Forecasts and Informational Content Disclaimer

Fishing forecasts, Fishing Activity Scores, weather data, lake conditions, fish location recommendations, and other content are estimates only.

We do not guarantee:

  • Fishing success;
  • Catch rates;
  • Fish location accuracy;
  • Water conditions;
  • Weather conditions; or
  • Any specific outcome resulting from use of the Services.

Conditions may change rapidly and without notice.

Users should independently verify weather, water, navigation, and safety conditions before engaging in outdoor activities.

8. Assumption of Risk

Fishing, boating, outdoor recreation, and related activities involve inherent risks, including:

  • Drowning;
  • Severe weather;
  • Equipment failure;
  • Water hazards;
  • Wildlife encounters;
  • Injury; and
  • Death.

You voluntarily assume all risks associated with your activities and use of information provided through the Services.

9. User Content

The Services may permit users to create and store personal fishing logs, notes, photos, catch records, and related information ("User Content").

User Content is stored privately for your personal use and is not publicly displayed through the Services unless expressly indicated otherwise.

You retain ownership of your User Content.

By uploading User Content, you grant Informed Fishing a non-exclusive, worldwide, royalty-free license to host, store, process, transmit, and display such content solely as necessary to provide and improve the Services.

You represent that you have all rights necessary to upload and use your User Content.

10. Prohibited Conduct

You agree not to:

  • Violate any law or regulation;
  • Interfere with operation of the Services;
  • Attempt unauthorized access to systems or accounts;
  • Reverse engineer or copy the Services;
  • Upload malicious software;
  • Use automated systems to scrape data;
  • Impersonate any person or entity;
  • Infringe intellectual property rights; or
  • Use the Services in a manner that may harm other users or us.

11. Intellectual Property

The Services, including software, content, graphics, logos, trademarks, Fishing Activity Scores, algorithms, designs, and related materials, are owned by Blue Sky Invention Company, LLC or its licensors and are protected by intellectual property laws.

Except as expressly authorized, you may not:

  • Copy;
  • Modify;
  • Distribute;
  • Reproduce;
  • Sell;
  • License; or
  • Create derivative works from the Services.

"Informed Fishing" and associated logos are proprietary trademarks.

12. Third-Party Services

The Services may incorporate or link to:

  • Weather providers;
  • Mapping services;
  • Payment processors;
  • E-commerce providers;
  • App stores;
  • Analytics providers; and
  • Other third-party services.

We do not control and are not responsible for third-party content, services, products, policies, or practices.

Your use of third-party services is governed by their respective terms and policies.

13. Privacy

Your use of the Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

14. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE."

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF:

  • MERCHANTABILITY;
  • FITNESS FOR A PARTICULAR PURPOSE;
  • NON-INFRINGEMENT;
  • ACCURACY;
  • RELIABILITY; AND
  • UNINTERRUPTED AVAILABILITY.

WE DO NOT WARRANT THAT THE SERVICES WILL BE ERROR-FREE OR THAT INFORMATION PROVIDED WILL BE ACCURATE OR COMPLETE.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLUE SKY INVENTION COMPANY, LLC, ITS OFFICERS, MEMBERS, EMPLOYEES, AFFILIATES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY:

  • INDIRECT DAMAGES;
  • INCIDENTAL DAMAGES;
  • SPECIAL DAMAGES;
  • CONSEQUENTIAL DAMAGES;
  • PUNITIVE DAMAGES;
  • LOSS OF PROFITS;
  • LOSS OF DATA;
  • LOSS OF BUSINESS OPPORTUNITIES; OR
  • PERSONAL INJURY OR PROPERTY DAMAGE ARISING FROM USE OF THE SERVICES.

OUR TOTAL LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE GREATER OF:

(A) THE AMOUNT YOU PAID TO US DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM; OR

(B) ONE HUNDRED U.S. DOLLARS ($100).

16. Indemnification

You agree to indemnify and hold harmless Blue Sky Invention Company, LLC and its affiliates from claims, damages, liabilities, losses, and expenses arising from:

  • Your use of the Services;
  • Your User Content;
  • Your violation of these Terms; or
  • Your violation of applicable law.

17. Suspension and Termination

We may suspend or terminate access to the Services at any time if:

  • You violate these Terms;
  • We reasonably believe your conduct may cause harm;
  • Required by law; or
  • We discontinue the Services.

18. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wisconsin, without regard to conflict-of-law principles.

19. Changes to These Terms

We may update these Terms from time to time.

Updated Terms become effective upon posting.

Continued use of the Services after changes are posted constitutes acceptance of the revised Terms.
